William R. Baerg

After practicing law for several years in Santa Monica, William R. Baerg joined Monteleone & McCrory in 1996. Although his areas of practice include general business and partnership litigation, his primary focus of practice is construction litigation involving both public and private projects.

He is experienced in all aspects of construction litigation including competitive bidding requirements and bid protests, mechanics lien and stop notice proceedings, subcontractor listing law requirements, total cost claims, delay damages, critical path method schedule analysis, False Claims Act litigation, construction defects and performance and payment bond remedies.

Mr. Baerg has represented owners, prime contractors, subcontractors and suppliers in a variety of different projects including subways, water treatment plants, pump stations, pipelines, commercial buildings and private residences.

He is an experienced litigator and has successfully tried numerous jury and bench trials in both state and federal court. His experience includes:

  • Obtaining a jury defense verdict in favor of a contractor wrongly accused by a water district of defective construction after a sewer line ruptured. After proving that the rupture was caused by the water district’s defective design, the water district was forced to pay all of the contractor’s legal fees.
  • Winning a judgment of over 6 million dollars in favor of a contractor against a water district who refused to pay the contractor for cost overruns and delay damages caused by design errors.
  • Forcing a city to pay a sewer line subcontractor its lost profits after its work was deleted by the city who unreasonably demanded that the inside of the sewer line have a “mirror” finish.
  • Obtaining an arbitration award of 1.7 million dollars in favor of his physician client against a multi-national healthcare corporation who breached a joint venture agreement.
  • Defending a non-profit housing cooperative against a former employee who falsely accused his client of workplace harassment.

A member of both the State Bar of California and the Washington State Bar Association, Mr. Baerg is also admitted to practice before all of the federal courts in California, the U.S. District Court for the Western District of Washington, the U.S. Court of Appeals for the Ninth Circuit, and the Supreme Court of the United States.

Mr. Baerg currently serves on the Planning Commission of the City of Arcadia and is a member of the board of trustees of various community organizations.

Mr. Baerg received his undergraduate degree with honors from the University of California at Los Angeles in 1990. He went on to obtain his law degree from Loyola Law School in 1993, where he was the production editor of the Loyola of Los Angeles International and Comparative Law Journal.
